Seller User Terms

This revision clarifies that Sellers must fully understand and agree to donate 100% of their proceeds (minus fees) to a charity before listing an item. It also emphasizes the requirement to set up a Stripe account for both themselves and their chosen charity to facilitate shipping reimbursements and ensure the charity receives its donation. It’s simple.

Introduction

These Seller User Terms (“Seller Terms”) govern your access to and use of our Services as a Seller. Our Services can be accessed through https://www.YourChoiceCharities.com. These Seller Terms are an integral part of the Terms of Use for Your Choice Charities, located [here], and together, they constitute the “Terms” that govern platform participation. Any terms (including capitalized terms) not specifically defined in these Seller Terms shall carry the same meaning as assigned in the Terms of Use.

Seller Registration and Account Approval

Before you can list items for auction using our platform, you must register and obtain account
approval from us. Approval is granted at our sole discretion.

Charity Selection and Donation Agreement

As a condition of listing Listed Item(s) for auction, you must agree to donate 100% of the proceeds from the auction sale of the item to the charity of your choice, less applicable payment gateway fees and Your Choice Charities’ (YCC) fees.  Your Choice Charities does not take possession of any items at any point. All items are listed directly by users—either individual donors or authorized charity representatives. YCC provides a selling platform and payment infrastructure only.  If a nonprofit organization lists an item, it is clearly being sold directly by the charity for its own benefit. While these items may appear similar to consigned goods, they are not consigned to YCC, and we hold no ownership or custodial responsibility for them.

By listing, Sellers agree that:

  • They retain possession of the item until it is sold and shipped.
  • All item listings must be truthful, accurate, and fulfillable.
  • YCC may label items for display purposes (e.g., “Sold on behalf of [Charity Name]”) to ensure buyer transparency.

Payment Processing and Seller reimbursement Through Stripe

Your Choice Charities uses Stripe as its payment gateway. (The most user friendly gateway.) If you, as a Seller, want to be reimbursed for shipping costs while ensuring that your charity receives its payment seamlessly, you create a Stripe account. It’s easy.

  • A Stripe account allows us to separately process reimbursement payments for shipping
    costs while the remaining auction proceeds go directly to the selected charity.
  • Without a Stripe account, you may not be able to receive any reimbursement for shipping
    costs.
  • All payment transactions, including donations and shipping reimbursements, will be
    subject to Stripe’s processing fees and policies.
  • Note: By using Stripe it keeps everything transparent and YCC ability to split payments
    for all who are involved.

Listed Items and Auctions

By using our Services as a Seller, you acknowledge and agree to the following:

  1.  We provide an auction platform but do not provide auctioneering services.
  2.  You are solely responsible for managing and conducting your auctions.
  3.  Any Listed Item(s) must be fully and accurately described.
  4.  You may not list any illegal items.
  5.  No external links or references are allowed in listings unless it’s the name of charity that was chosen.
  6.  Unsold items are considered withdrawn unless relisted with applicable fees.
  7.  Each item must be a real, available item. Multiples are allowed when identical.
  8.  You may set an opening or reserve price.
  9.  You must honor the winning bid.

Note: We (YCC), in Phase Two (2) will be offering live estate, celebrity and other type of auctions that will require auctioneering services, real-estate brokers and other needed personnel to conduct those auctions.

Item Representation and Transparency:

Note:  All item listings will identify whether the seller is a supporter or a registered charity, using labelssuch as “Sold by (Name)” or “Sold by (Charity Name).” When a charity lists an item, it is considered a consignment-style arrangement—However, YCC does not hold, inspect, or manage the item, and is not responsible for its description, shipping, or delivery.
YCC does not act as a seller on behalf of any individual or organization. Instead, we provide the platform, technical framework, and listing format to help charities liquidate non-cash assets through our site.  These labels are used to ensure clarity for bidders and distinguish seller relationships. They do not imply legal ownership or custodianship by YCC.

Prohibited Seller Conduct
Buyback & Price Manipulation: You may not:

  • Bid on your own items or have someone else do so for you.
  • Manipulate pricing by deceptive practices.
  • Violations may lead to permanent removal from the platform.

Fees & Payment Obligations
You agree to pay all applicable fees:

  •  Platform fees for auction use.
  •  Payment processing fees.
  •  All fees are non-refundable.

No Guarantee of Sale or Payment
We do not guarantee:

  •  That items will sell.
  •  That you will receive bids.
  •  That the price will meet expectations.
  •  All sales are final.

Independent Transactions
Your Choice Charities does not:

  •  Buy, sell, or take items on consignment.
  •  Act as a broker or agent.
  •  Store or ship any items.
  • While items may be described as "old on behalf of" a charity, YCC is not in possession of any items listed and is not a party to the item transfer.

Seller Indemnification
You agree to indemnify YCC against claims from:

  •  Breaches or misrepresentations.
  •  Environmental, legal, or tax violations.
  •  Bidder disputes.

Conflicts Between Terms
In the event of a conflict, the Terms of Use take precedence.

If you are an independent seller, you are required to contribute 100% of the proceeds from your sales to your chosen charity. If you do not specify a charity, proceeds will be donated to the YCCI Fund, and we will select a charity on your behalf. As a seller, you are responsible for the accuracy of your item descriptions, timely shipping, and adherence to all terms. The listing of prohibited items is strictly forbidden.
