Bidder / Buyer Participation Terms
Introduction
These Bidder Participation Terms (referred to as the “Bidder Terms”) outline the guidelines for accessing and utilizing our platform as a Bidder. OurServices are available through https://www.yourchoicecharities.com.
These Bidder Terms are an integral part of the Terms of Use for Your Choice Charities, which can be found [here]. Together, they constitute the “Terms” governing platform participation. Any terms (including capitalized terms) not specifically defined in these Bidder Terms shall carry the same meaning as assigned in the Terms of Use for Your Choice Charities.
Bidder Account Authorization
To participate as a Bidder, you must first register an account with us. Account
approval is subject to our sole discretion, and you will not be able to access
our Services as a Bidder until your registration has been reviewed and
approved.
Listed Items
We are not the owner, seller, or auctioneer of the items listed on our site
("Listed Item(s)"). We do not inspect the Listed Item(s), verify a Seller’s
ownership, or confirm their authority to sell. Additionally, we do not provide
warranties or guarantees regarding any Listed Item(s).
Bidding on Listed Item(s) is entirely at your own risk, and any resulting
transaction is solely between you and the Seller. We do not oversee, manage,
or control Sellers—they operate independently and are bound by their
own Seller Terms.
By using our Services, you acknowledge and agree that:
 We are not liable for Listed Item(s) that you bid on.
ď‚· We are not responsible for the actions, omissions, or commitments of
Sellers.
ď‚· We do not regulate or intervene in transactions between you and a
Seller.
ď‚· It is your responsibility to verify all claims made by the Seller before
placing a bid.

Furthermore, we are not a real estate broker, associate broker, real estate
agent, salesperson, appraiser, mortgage broker, or lender.
Transaction Independence
We are not engaged in the business of buying or selling Listed Item(s) on a
commission basis, nor do we accept Listed Item(s) on consignment. Any
transactions that take place on our platform are solely determined through
direct interaction between Sellers and Bidders.
We do not:
ď‚· Act as an employee, agent, representative, broker, dealer, real estate
professional, marketing agency, or middleman for any party.
 Handle, store, ship, distribute, process, or take possession of any Listed
Item(s).
ď‚· Collect, process, or remit any payments related to the purchase or sale
of Listed Item(s), including livestock, poultry, or other animals.
Additionally, we are not registered with the U.S. Department of Agriculture,
Grain Inspection, Packers and Stockyards Administration under
the Packers and Stockyards Act of 1921. We are also not bonded for the
protection of Sellers, Bidders, or users of our platform.
Auction Information and Bidder Inspections
The auction details, item descriptions, and pricing for Listed Item(s) are set
by the Seller and may change at their discretion. Listed Item(s) may be pre-
owned and could contain defects.
We do not:
 Inspect or verify the Listed Item(s) or their condition.
ď‚· Validate the accuracy of Seller-provided information.
ď‚· Guarantee that Sellers comply with relevant legal or licensing
requirements.
You are responsible for taking necessary steps to:
 Independently verify the accuracy of Listed Item descriptions.
 Inspect the condition of the Listed Item(s) before placing a bid or
finalizing a purchase.
ď‚· Ensure that any legal, financial, or regulatory obligations related to
the Listed Item(s) are met.

We reserve the right to:
 Remove any Listed Item(s) from our platform at our discretion.
ď‚· Modify item descriptions if necessary.
ď‚· Cancel any suspicious or fraudulent bids and report such activity to the
relevant authorities.
Seller-Specific Terms and Fees
Additional Seller Terms
Sellers may impose additional terms and conditions (“User Posted Terms”)
that apply specifically to their Listed Item(s). These are separate from
our Bidder Terms, and it is your responsibility to review and understand
them before bidding.
We do not create, review, negotiate, or enforce User Posted Terms. If you
disagree with them, do not place a bid.
Additional Fees
Sellers may charge additional fees beyond the final auction price, such as:
ď‚· Shipping, handling, and processing fees.
These fees are set and controlled by the Seller and are subject to
change.
Responsibilities for Transportation and Risk of Loss
We are not responsible for the transportation, handling, or risk of loss of
any Listed Item(s). Additionally, we are not liable for:
 The condition of Listed Item(s), including any damages, defects, or
hazards.
ď‚· Compliance with environmental, zoning, or regulatory laws related to
the Listed Item(s).
 Any third-party claims, liens, leases, or encumbrances associated
with the Listed Item(s).
If you are the winning Bidder, you are solely responsible for:
 Ensuring compliance with all applicable transportation and shipping
laws.
 Covering all costs related to transporting and caring for the Listed
Item(s).
 Obtaining necessary health certificates and regulatory approvals for
shipment.
Bidding Process
By placing a bid on our platform, you acknowledge and agree that:
 Your bid is irrevocable and may be legally binding.
ď‚· If you win an auction, the Seller may require you to complete the
transaction.
 We are authorized to share your contact and bidding information with
the Seller.
Automated & Extended Bidding
 You may set a maximum bid, which allows our system to place
automatic incremental bids on your behalf until your max bid is met.
 Some auctions may have time extensions, meaning bidding can
continue past the stated end time if higher bids are placed within a
specified window.
We reserve the right to:
 Withdraw or cancel any Listed Item(s) without notice.
 Void bids we believe to be fraudulent, manipulative, or against our
Terms.
The Seller ultimately conducts the auction and has the final
authority regarding the sale of Listed Item(s).
Prohibited Bidder Conduct
The following activities are strictly prohibited:
 Shill bidding (placing bids to artificially inflate the price).
 Bidding on your own items (directly or through an agent).
 Coordinating bids with other Bidders to manipulate auction
outcomes.
Bidder Indemnification
By using our platform, you agree to indemnify and hold us harmless
against any and all damages, claims, or liabilities that arise from:
 Your inspection or presence at a Seller’s location.
ď‚· Any injury, damage, or loss associated with the sale, removal, or use
of Listed Item(s).
Conflicts Between Terms
In the event of a conflict between these Bidder Terms and the Terms of Use
for Your Choice Charities, the Terms of Use for Your Choice Charities shall
prevail.
